MY SECOND-HAND CAR TURNS OUT TO BE A ‘LEMON’

I bought a second-hand car from a dealership about three months ago. The last week I’ve noticed that the engine sounds terrible. I asked a mechanic to have a look at it and according to him the engine is shot and needs a complete overhaul, which will be very expensive. The dealer said nothing about the engine being in such bad shape. But it is a second-hand car, so I’m not sure if I can return it or have the dealer fix it properly?
Having bought the car from a second-hand dealer, means that the Consumer Protection Act of 2008 (“CPA”) will apply to your transaction. Importantly, a second-hand car falls within the definition of ‘goods’ in the CPA and is thus also subject to the CPA protection against defective goods, because excluding second-hand goods from the ambit of the CPA would exclude protection for consumers who need it most.
The CPA provides an automatic warranty that all goods purchased comply with the following requirements in terms of the CPA:

•safe, of good quality, in good working order and free from any defects;
•reasonably suitable for the purpose for which they are generally intended; and
•will be usable and durable for a reasonable period of time, having regard to the use they would normally be put to.

Should purchased goods fail to meet the requirements as set out above within six months after the purchase or delivery of such goods you have the right to return them, and insist on one of the following three remedies:

•Have the goods repaired
•Have the goods replaced
•Obtain a full refund of the purchase price.
In general, if a consumer prefers to have the defective goods replaced or to have the purchase price thereof refunded, the supplier must comply and cannot force the consumer to have the goods repaired instead. The supplier is also liable for the costs of repairing, collecting and/or replacing the defective goods. It is important to remember that the defect of the goods must be a material imperfection to qualify for one of the three remedies. The CPA will also apply regardless of the suppliers’ refund policy, unless the refund policy is more favourable towards the consumer.
In the case of second hand goods, there are exeptions to the rules regarding refunds in that they do not apply if the consumer was specifically informed of the specific defects of the particular item and the consumer still agreed to purchase the item in that condition or the goods were altered contrary to the instructions, or after leaving the control, of the dealership.
In your case, it is realistic to accept that the standard and condition of a new car will differ from that of a second hand car and that it’s not always possible for a second-hand car dealer to point out the exact wear and tear of the car. That said, a second hand dealer should be in a position, due to the nature of his business, to be able to point out known defects as well as bigger and obvious defects. Should any defects, other than those listed and accepted by the consumer, occur within six months after the delivery of any such goods,, you will have the right to insist on one of the three remedies listed above.
In your situation, if the condition of the engine was not disclosed, it can be argued that the need for you to have to overhaul the entire engine is material and should afford you the protection and remedies provided by the CPA. Great Britain’s Justin Rose became golf’s first Olympic champion since 1904 by beating Henrik Stenson to gold in a thrilling final round at Rio 2016.

EMOTIONAL INTELLIGENCE (EI) AND THE ENTREPRENEUR

The role that Emotions play in the personal life of an entrepreneur is of vital importance. In fact, it can influence functioning in all life areas positively or negatively. However, most often we are not even aware that our emotions or feelings determine if we are going to start with and complete a specific task or project! If we think about it that a project can become a product and/or service that can earn money, it indicates that the effective management of emotions is very necessary for entrepreneurs.Emotions also carry messages and warn us to make certain small changes or big adaptations in life.
Consequently, to have knowledge about emotional intelligence (EI) can help entrepreneurs to improve their quality of life as well as those of others gradually.Simply put EI, is when we can identify, understand and control our own feelings and thoughts as well as communicate it clearly to other people. It also demonstrates that we understand others’ feelings correctly and are able to develop strong and lasting relationships.

8 FOODS TO AVOID TO KEEP BELLY FAT AWAY

Belly fat is linked with higher risk of developing various health issues, such as diabetes, heart disease, high blood pressure, stroke and even certain types of cancers. I’ve already written about the best foods that help fight belly fat . But eating the right foods is not enough as being physically active is a key to losing belly fat and should be combined with healthy nutrition.

But when talking about what foods to eat we also need to know what food categories to avoid. You may have to make some sacrifices that shake up your daily diet, but finding healthy alternatives will provide priceless incentives. The categories make up the 8 worst foods for packing on belly fat, some more obvious than others, but all of them are an equal threat to building body fat.
1. Refined Grains
Grains can be great, and as a matter of fact the food pyramid says they should make up a relatively big part of your diet. They can reduce the risk of heart disease, promote healthy digestion and even help with weight management. But if you’re ingesting the wrong type of grains, you might be doing the opposite of weight management.
Refined grains such as white bread, white rice and carb-loaded snacks go through a refinement process that takes away nutritional value and leaves the consumer feeling less full. Switching to whole grains will be more satisfying and place you in a demographic associated with lower levels of abdominal fat. 2. Sugary Drinks
These are the silent villains of fat gain. People hardly expect their liquid calorie intake to contribute to fat, yet it’s a prevalent issue in the U.S. The Harvard School of Public Health found in a study that the disheartening amount of obese people in the country has been fueled by sugar-laden drinks such as sodas and juices. One bottle of soda can contain more than 200 calories, the equivalent to some value fast-food cheeseburgers. They also elevate the risk of heart disease and diabetes, so stay mindful of your drink labels.
3. Hydrogenated Vegetable Oil
Like grains, oils that provide fats can be great for health, but only if you consume the right kind. Hydrogenated vegetable oil are loaded with trans fats — the only type of fats with absolutely no nutritional incentives. They pack foods with calories that your stomach can’t burn off and dangerously add to high cholesterol levels. Olive oil and other sources of healthy fats are good for your diet when consumed in moderation and should completely replace trans fats if you’re taking stomach fat loss seriously.
4. Fatty Animal Product
As we mentioned above, the healthy fats derived from some oils, nuts and fish are great for your health, but there are still options other than trans fats to avoid. While slightly more nutritional than trans fats, saturated fats from meat and dairy products can still pack on unwanted body fat. The most common source of these fats are fatty cuts of meat, butter, cream and whole milk. While saturated fat is a necessary part of a balanced diet, you only need a small amount of it to fully benefit it’s health properties, so they don’t have to be completely cut from a diet, but they should be limited.
5. Fried Foods
They’re a staple of state fairs and fast food joints, but you should know by now that the delicious taste of fried food comes with a price. While you may be entertaining your taste buds, you are also increasing your risk for obesity, stroke, fat gain and even cancer. The nutritional value of foods that are plunged into deep fryers is slim, with little vitamins and a wonky balance of macronutrients. Fighting the temptation of deep fried Oreos for a healthier alternative could be the next big step to a flat stomach.
6. Alcohol
Perhaps one of the most unexpected items on the list is alcohol. Consumption excess amounts of alcohol makes the liver work hard on filtering it out and forget about burning off fat. The major villain here ties in with the above-mentioned sugary drinks. A single drink is loaded with calories, often sugars that are quickly stashed as body fat. There is also the link to junk food binging when consuming alcohol — maybe the ten beers that lead to a late night pizza aren’t doing a flat stomach any justice.
7. Pastries
They might mark special occasions, like a big cake on a birthday or cookies on Christmas, but baked goods are hardly ever a nutritionally sound choice. They are nice for a very occasional treat but the high levels of sugar and fat as well as an absence of protein make them a menacing fat gainer. Even snack bars that boast a “healthy look” can be loaded with sugar. Read the label before you eat and try to find healthier alternatives to constant cake and cookies. 8. Foods High in Sodium
Salty products are probably one of the shadiest contributors to fat gain because they can’t be measured in calories. Sodium is prevalent in plenty of modern processed foods because of the way it enhances taste and preserves longevity, but it also contributes to a rounded stomach. Sodium causes water retention, and when too much is consumed it can lead to a bloated stomach. Sodium can also dangerously alter your blood pressure if you consume too much of it. Keep your eyes peeled for the sodium content of processed foods at the supermarket, you may be surprised which ones are loaded with it.

AGGRESSION DUE TO DOMINANCE

What should I do if I think my dog is becoming aggressive? Is this something my young dog will just outgrow? Are there some things I can do at home, and where do I start?”
Aggression in dogs is an important behavioral problem; in fact, it is the most common problem seen at animal behavior clinics. Like any other behavioral problem, there is no ‘quick cure’ for aggression. However, if an owner is willing to get qualified help and put in the time and effort required, aggression can usually be controlled. I am not an animal behaviorist, but like other veterinarians, I really sympathize with my clients who struggle to know how to deal with an aggressive dog. In this article, we will look at dominance aggression. We will also go over some useful tips, and some resources for owners looking for help.

Dominance aggression – What is it?
Most dogs are content to let people be in charge. As puppies, they quickly learn to look to us to let them know what we want them to do. Some dogs seem to have a harder time with this. A dominantly aggressive dog will consistently growl, snap, or bite when a person does something, or asks the dog to do something, which the dog does not like. This is different than a dog that is assertive or pushy, but will obey a firm command. This is also not the same situation as a dog which has been pushed beyond her limit by cruelty or pain. A dominantly aggressive dog has an inappropriate response to normal situations. The dog is trying to control the situation with her reaction, rather than allowing a person to have control.
These dogs may be protective over food or toys, or favorite sleeping areas. They may react if they are groomed, or if you stare at them, or if they are punished. In the beginning, the problem usually only occurs at certain times, for example, if you disturb your dog while she is eating. Then it begins to occur more often, when you move to place the leash over her head, or tell her to get off of the sofa, etc. The problem is not the situation, but the issue of control. Yelling, or physical correction such as scruffing, rolling the dog over, or “hanging” the dog by her collar or choke chain are not appropriate or effective form of discipline, and will only make matters worse. These attempts to “show the dog who is boss” may challenge the dog to be more aggressive, may injure the dog, and do nothing to teach the dog a more appropriate behavior in place of aggression.
Dominance aggression usually begins at around 18-24 months of age, when dogs become socially mature. Less commonly, it can occur in puppies as young as 4-5 months. While intact dogs may have a higher tendency towards dominance aggression, spaying or neutering alone will not solve the problem once it has started. Effective treatment involves behavior modification, combined with anti-anxiety medication, if needed.

What can I do about it?

As with any behavioral problem, some basic guidelines apply:
Set up an appointment with your veterinarian, to talk about the situation and have a thorough physical examination performed. Some rather common health problems can make an otherwise even-tempered dog aggressive. These include but are not limited to epilepsy, hypothyroidism, arthritis, hip dysplasia, and dental disease. Your veterinarian may recommend some testing such as a complete blood count, a chemistry panel, or a thyroid test.
If your dog is aggressive towards people, be realistic with yourself about the situation. If the way your puppy nips at you when she plays concerns you, do not just hope that she will outgrow it, get some help to stop the behavior. If your adult dog growls when people walk past while she is eating, do not just assume that she will never take things a step further and bite someone. Problems like these are much easier to control early on, before you have a dog that you are afraid of, or that has bitten someone. Unless you have worked with dogs with behavior problems, the best way to help your dog is to get assistance from a professional. Choose a trainer, veterinarian, or animal behaviorist with lots of experience in this area. Especially if your dog has already bitten someone, doing the wrong thing can make the situation worse, with serious results. It can be very helpful to have someone to talk to and ask questions of, especially if your dog does not seem to be responding in the way you expected. If you choose to work on the problem alone, you are taking a tremendous responsibility for the safety of the people and animals that dog comes into contact with.
Collie with a Frisbee Increase the exercise. Dogs that get enough exercise are far less likely to have behavioral problems – of any kind – than dogs that are couch potatoes. How much exercise is enough? Most of us under-estimate the amount of exercise our dogs need: many trainers and behaviorists recommend 45-60 minutes of brisk exercise (until the dog is panting) twice a day! Running after the occasional squirrel in the back yard will not do it; the dog needs fairly continuous exercise to burn off all that energy he has built up while he has been waiting for you to come home. Play Frisbee with your dog; take her swimming, out in the woods to run, to a dog park, to doggie day-care. Take your dog jogging with you. Small breed dogs need plenty of exercise, too. They can go on long, brisk walks. They can play fetch. This is a game you can play outdoors or inside in a long hallway. Use several balls, so you can keep things moving. Ask the dog to sit before you throw the ball each time. Also keep in mind that many types of dogs were bred to do a job. Give them the mental stimulation they need with obedience or agility classes, field trials, learning new commands, etc.
If your dog is not used to this much exercise, you will need to increase it gradually. If your dog has any health problems, consult with your veterinarian about a safe exercise program. Obviously, if your dog is aggressive to other dogs, doggie day-care or a dog park may not be a good idea. And exercise alone will certainly not be the total answer for a dog’s behavior problems. However, increased exercise can really help to ‘take the edge off’ (think of how relaxed you feel after a good work-out).

MAMMOGRAM OR THERMOGRAPHY- WHICH IS BETTER?

The breast cancer industry’s holy grail (that mammography is the primary weapon in the war against breast cancer) has been disproved. In fact, mammography appears to have CREATED 1.3 million cases of breast cancer in the U.S. population that were not there. Mammograms are performed today for two reasons: they help detect breast cancer and also help confirm a diagnosis if another screening option shows the presence of cancerous cells.
Mammograms might be able to help screen for breast cancer in some cases, but they do nothing to help prevent or treat breast cancer (in fact, the opposite might be true). Clinical trials regarding breast cancer screening technologies, including mammograms, have overall shown conflicting results. Potential Dangers of Mammography- In 2001, the Cochrane Institute carried out an analysis to study findings about mammography screening and pointed out that overall screening can actually be harmful because it frequently leads to overdiagnosis and overtreatment.
They also found that many advocacy groups and websites in favor of mammograms accepted sponsorship from the mammogram industry without restriction. This results in certain organizations promoting the benefits of mammograms without also revealing the risks and drawbacks. The same issue is also a problem when it comes to treating cancer naturally versus with more aggressive approaches.
A Better Option Over Mammogram
Thermography (ThermoScan) is a state-of- the-art, potentially life-saving, non-invasive technology that does not use radiation or compression to measure heat emissions from the body. Thermography measures infrared heat from your body and interprets the information in images that can be tracked over time to look for changes. This heat pattern of the body will indicate inflammation as a “hot spot” to indicate possible illness or disease. It’s painless, easy to perform, can be performed in pregnant women and can be just as effective and accurate (if not more) as mammograms. Using thermography,doctors can detect cancerous tumors in its early stages, offering patients the best chance of recovery. Of course, prevention is also key. Eat a healthy diet with cancer-fighting foods, get enough exercise, reduce stress and limit toxin exposure to lower your risk as much as possible.
